Welcome to Record, Mix and Master.
These Terms and Conditions (“Terms”) govern the purchase, download, and use of music sample library packs (“Products” or “Sample Packs”) from www.recordmixandmaster.com (“Website”).
By purchasing or downloading any Product from this Website, you agree to be bound by these Terms. If you do not agree, you must not use or purchase any Products from this Website.
1. License Grant (What You Can Do)
When you purchase a Sample Pack, you are granted a non-exclusive, non-transferable, perpetual, royalty-free licence to use the individual audio files (samples, loops, one-shots, etc.) contained within the purchased Product, subject to these Terms.
You may:
- Use the samples in combination with other sounds to create your own original musical compositions, recordings, and productions (“New Works”).
- Release, distribute, and sell your New Works commercially (including digital streaming, physical releases, film, TV, radio, podcasts, advertising, and video games) without paying additional royalties or licence fees to Record, Mix and Master.
- Modify, edit, or manipulate the samples as part of your creative process.
Ownership and copyright of all samples remain at all times the property of Record, Mix and Master. You are purchasing a licence to use the sounds, not ownership of the sounds themselves.
2. Restrictions on Use (What You Cannot Do)
The licence granted to you under these Terms is limited. You must not:
- Repackage, resell, redistribute, lease, rent, or sublicense the Sample Packs or individual sounds, whether in original or modified form.
- Include any samples in another sample library, sound pack, virtual instrument, plugin, or similar product, whether commercial or free.
- Upload, share, or distribute the samples via file-sharing platforms, peer-to-peer networks, or social media.
- Use the samples in isolation (for example, as individual sound effects or ringtones).
- Transfer or assign your licence to another person or company.
Any unauthorised use of the Samples may result in immediate termination of your licence and may constitute an infringement under the Copyright, Designs and Patents Act 1988.
3. Licence Termination
Record, Mix and Master reserves the right to terminate your licence if you breach any part of these Terms.
If your licence is terminated, you must immediately stop using the Products and permanently delete all copies from your systems.
Termination does not affect any New Works created prior to termination that were made in compliance with these Terms.
4. Digital Products and Refund Policy
All Products sold are digital downloads. Once a purchase has been completed and the files made available, all sales are final and non-refundable, in accordance with UK consumer law exemptions for digital content.
By purchasing and downloading any Product, you acknowledge and agree that you waive your 14-day right to cancel once the download or streaming of digital content has begun (Consumer Contracts Regulations 2013, Regulation 37).
If you experience a technical issue (e.g., corrupt download or broken link), please contact us within 7 days of purchase at admin@recordmixandmaster.com. We will ensure replacement access or technical assistance within 2 business days.
5. Intellectual Property Rights
All content on this Website, including but not limited to audio files, product descriptions, design, text, images, and logos, is the property of Record, Mix and Master and protected under the Copyright, Designs and Patents Act 1988 and international copyright treaties.
Unauthorised copying, distribution, or reproduction beyond the scope of your licence is strictly prohibited and may lead to civil or criminal penalties.
6. User Accounts (If Applicable)
If you create an account on this Website, you are responsible for maintaining the confidentiality of your login details and for all activity carried out under your account.
Record, Mix and Master reserves the right to suspend or terminate accounts associated with misuse, fraudulent activity, or violation of these Terms.
7. Limitation of Liability
To the fullest extent permitted by UK law:
- Record, Mix and Master shall not be liable for any indirect, incidental, or consequential damages (including loss of profits, data, or goodwill) arising out of the use or inability to use the Products or Website.
- Our total liability in respect of any Product shall not exceed the amount paid for that Product.
Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any matter where liability cannot lawfully be excluded under UK law.
8. Disclaimer of Warranties
All Products are provided “as is” and “as available”, without any representations or warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.
Record, Mix and Master does not guarantee that the Products will meet your individual requirements or that they will be compatible with all software or devices.
9. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.
You agree that the courts of England and Wales shall have exclusive jurisdiction over any such disputes.
10. Changes to These Terms
Record, Mix and Master may update or amend these Terms from time to time.
Any changes will be effective immediately upon posting on this Website. Your continued use or purchase after such changes constitutes acceptance of the updated Terms.
11. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal data in accordance with the UK GDPR and the Data Protection Act 2018.
- Any personal information collected (e.g., name, email, payment details) will only be used to process orders, provide customer support, and send transactional or service-related communications.
- We will not sell or share your personal data with third parties for marketing purposes without your consent.
